Protecting the Honorable Title, Kentucky Colonel
In 2021-2022 after spending a year in court with the Honorable Order of Kentucky Colonels (HOKC) and derailing their SLAPP Suit against Kentucky Colonels International (Original Facebook Groups) having their case dismissed with prejudice, we realized we inadvertently established new precedential civil law for the Kentucky Colonel based in the orders of the court, the Order (an Agreed Permanent Injunction) prevents the HOKC (aka Kentucky Colonels ®) from bullying colonels (with legal demands) that use the term "Kentucky Colonel" to describe themselves independently of their organization; it also prevents them from engaging in history based on their commercial nature which we found scattered defending the case; the Order also authoritatively warns me (and all other colonels) not to use the registered trademarks and service marks Kentucky Colonels® for any of the reasons outlined and essentially in what is interpreted in law to say, "not to confuse Honorable Order of Kentucky Colonels® with the office, person, or title the Kentucky Colonel, Kentucky colonels, or Kentucky colonelcy" and Kentucky Colonel ™ which we are adding now, very simply because it represents an unregistrable common-law position that can only be used by an actual honorable title holder, we are calling it a Title Mark instead of trademark, essentially because most often will appear as one in association with a person's signature, name or leading presentation.
There is No Ongoing Debate
The Court Order reading it over and over again, learning more about the law, literally made us finally come to realize, that based on information that we revealed and rediscovered that was hidden and unconnected with them which forced the case to a Magistrate Court for settlement, essentially did not have much to do with the case at all, it had more to do with their own domination, power and control over the term. The assimilation created in 1936-1941 generated a constructive illusion around pseudohistory (folklore) or a fictional narrative (propaganda) to become very popular and accepted, that has been passed off as reality shrouded in mystery, controlled by uncommissioned generals, to represent a surreal idea of a mythical militia without an defined origin. How do you control or supplant a fictitious reality? Everyone is not fooled.
We don't! The website authors do not recognize the Honorable Order of Kentucky Colonels as "Real Kentucky Colonels" simply because they are formed based on a mythical background story of 1813 and because our story of the Kentucky Colonel actually does begin in 1775 with the "First Kentucky Colonel, Daniel Boone" our disambiguation of history and myth has revealed many previously unknown details. The HOKC fails to show any real connection with the title, it also appears they took it over in 1932 outright, disregarding the history when it was misappropriated for political and financial gain; it is best to disregard them as serious actors in the matter, or with any interest in protecting the title and regulating its use.
History Matters to the Kentucky Colonel!
Considering we counted 387 colonels in Kentucky before it became a State in 1792 when it was called a District are also Kentucky colonels, why not? It would be unfair to their legacy and our own heritage to say that they were not the "First Kentucky Colonels" and "Real Kentucky Colonels" or "Original Kentucky Colonels" especially since many of Kentucky's counties are named after these colonels, should there be any disagreement?
There is no evidence of a Kentucky Colonel Commission in 1813 except to Col. Richard Mentor Johnson, in an act by the Kentucky Legislature; once that was concluded as fact we began to look for the Kentucky Colonel before 1813. We also confirmed that Captain Charles S. Todd did not become a colonel until 1815 in the Northwest Territory before returning to his home Kentucky and met for the first time Governor Isaac Shelby, who actually was a Kentucky Colonel in 1780. Governor Shelby got Col. Todd a job as the Secretary of State, put in a good word anyway, because Todd married his daughter.
The only concept that the HOKC does adopt that is consistent with the customs and traditions of Kentucky Colonelcy is the Mint Julep which is a drink got its first mention in print in 1803, when it was described as a "dram of spirituous liquor that has mint in it, taken by Virginians in the morning." Everything else, the uniform, commanding generals, commander-in-chief, 1813, Col. Charles Todd is all based on the misinformation that the HOKC provided based on getting started on the wrong foot; the HOKC admits themselves in 1941 and 1947 its position and actual knowledge as to what a Kentucky Colonel is or was, this is made very clear in "The Kentucky Colonel: A Study in Semantics" in 1947.
Look at the Timeline of the Kentucky Colonel (1775-2025)
We will celebrate the 250th Anniversary of the Kentucky Colonel in 2025, that is just two years from now. We are working on a number of programs and talking with merchants from the area to see how we can promote the celebration now. It may be a large event, there are more than 10 other organizations closely connected to Transylvania where the Kentucky Colonel began.
Later in 2022, when working with Indigenous Intellectual Property and the United Nations on the origin and biocolonialism of the Indigenous Peoples intellectual property; like the invention of "chocolate" and "cacao". We traced it to its discovery over 6,000 years ago by Pre-Columbian tribes that engaged in commerce with the Spanish, English, Dutch, Italians, Germans and Swiss in the late 1700's and 1800's. We traced it back to 1522 when Emperor Charles V wrote a letter to Cortes who is credited with the Conquest of Mexico about "chocolata" attributing its discovery and invention to the Indigenous Peoples (with whom Cortes was fighting). This also brought us to understand the Origin of the Kentucky Colonel.
So now we are forming a business based on the Origin of the Kentucky Colonel being exactly that, "Indigenous to Kentucky" or "Native to Kentucky" because when you ask the question; Which one came first the Colonel or Kentucky? the answer becomes obvious.
Either way or whatever you may think, when a case is dismissed with prejudice it means that the Plaintiff in the case has lost, and most likely had no case at all to begin with because the Kentucky Colonel never had a master, it is an Honorable Title on its own, it always has been since 1775 and it will always provide all the "rights, privileges and responsibilities thereto appertaining" whatever they may be as they have always been granted! With privilege comes power and responsibility becomes honorable.
Cooperative Colonels of Old Kentucky
We affirmed the presumption that Kentucky was crafted, originated, projected and sourced by 17 delegates of which 13 were colonels (under which were about 300-500 colonists) under notably legal sovereign democratic circumstances understanding modern American law today, they were the colony's commissioned officers. The state they created was the Transylvania Colony under the Kentucke Magna Charta, (Letter and Constitution). The so-called ideals that were created and enacted as constitutional law remain as the foundation of Kentucky Government today. The colonels created the scope for what would soon become Kentucky County of the Commonwealth of Virginia, then it became the Kentucky District as the gigantic Kentucky County was subdivided by its new county colonels. In 1791, the colonels got together and selected Col. Isaac Shelby (also a Kentucky Colonel, obviously) as the first governor. By 1800 after Kentucky became a state there were 328 mostly civilian company, county and civil militia colonels that owned property in Kentucky from Revolutionary War land warrants.
This created reason and motive to thoroughly reexamine the historical transcript of Kentucky starting at the beginning to move forward, scrapping the contemporary knowledge to find the Real Kentucky Colonels hiding in plain sight, to distinguish and disambiguate indisputable facts from fiction and myth; without any careless disregard of the fictitious history and folklore used to enrich culture or serve literary creativity as the guideposts of our civilization. We believe that all colonels that came to Kentucky and those the counties were named after are the first of the Kentucky colonels which emerge in American literature in 1824. One of the most important facts that are left out of Wikipedia is that Kentucky was originated, organized and established by colonels (mostly colonels), three times in 1775, in 1776 and 1791. Are there any other questions that need to be answered about the Kentucky Colonel or where the first colonels came from? Kentucky had colonels everywhere before it became a state!
Historians know that history does not come alive until they look at it from the beginning to fully understand the actual source and origin of the subject, the true and actual facts behind the beginning are the most dramatic and the most relevant today to understand the significance of our way forward.
While we have all the data and historical information, it is far from complete enough to determine exactly how the honorable title becomes an authoritative tool of empowerment since it began. In Kentucky in 1775, it is "Honorable" not "The Honorable" because "The" would refer to "one", it has been that way ever since when the Colonels were the Kings and heads of their colonies. It is believed that the sovereign fount of honor of these colonels was the Divine Elm tree which they recognized as a living being and the well known facts surrounding its size to be large enough to protect 100 people from the rain, the speech began "You are called and assembled at this time for a noble and an honorable purpose..." .
Organizing an Equitable Start-Up (A Cooperative)
Globcal International in November 2022 based on the actions by Facebook Compliance to block the Kentucky Colonelcy Facebook Page have agreed to assist us once again to establish an autonomous decentralized regulatory body with Kentucky Roots in Richmond to assist in financing our educational and informative publishing efforts as is consistent with law using our websites and 1998 copyright. The business (a cooperative) will be established by the owners for the owners and their designated beneficiaries for the publication of their work using available forms of media, the organization is a social enterprise for its members, it shall not be established for charitable, fraternal, or philanthropic purposes; instead cooperatives focus on the needs of their members to create mutual benefit.
While our formation stage is a non-profit project of our sponsor organization(s) as a cooperative the Transylvania Company and the Kentucky colonels invested will become an independent entity when it is incorporated by its cooperative owners on January 02, 2025 (if not sooner). Most of the members of both Ecology Crossroads Cooperative Foundation and our strategic organization partner Globcal International are staffed and operated by mostly Kentucky colonels, their organizational structure and articles of incorporation provide us the necessary safe harbor to organize our cooperative member owned formation.
Transparency is the Key to Colonelcy
Application for employment within your own authority as a self-employed Professional Kentucky Colonel in our Commonwealth Cooperative ("Company" now in formation for 2023), please read carefully, this material is important legal information and relevant to your Trademark (Title Mark), Legal Rights, Qualified Immunity, Privileges, Benefits and Responsibilities as a Kentucky Colonel understanding common-law doctrines and protocols locally, domestically, and internationally. This effort constitutes an independent objective to identify, license, protect and regulate ourselves in a collectively private held company under the unregistrable common-law trademark (TM) symbol for our exclusive unregulated rights used to define the (person and title) Kentucky Colonel in actuality, collectively, descriptively, generically, perceptively and realistically for commercial and non-commercial purposes in the public and private sectors in accordance with a 2021 Federal Law (Court Order) summarized with emphasis states:
- Kentucky colonels (as individuals) shall not be prohibited (or restricted) from using "Kentucky Colonel," "Kentucky colonels" and/or "Kentucky colonelcy" as words or terms to describe themselves, ... as an a honorary title, for editorial, educational, informative, journalistic, literary or other non-commercial (or lawful) purposes so long as the use is not related to any trademark or service mark uses registered with the United States Patent and Trademark Office.
Our new effort depends on the literal historical record based on published works from 1775 - 1925 telling the story of the Kentucky Colonel, observing Title 15 U.S. Code § 1125 - False designations of origin, false descriptions, and dilution forbidden: Where irony, myth, folklore, fiction, parody and non-fiction converge where they are most often understood and misunderstood or piqued to someone's collective illusion.
- Any person who, on or in connection with any goods or services, or any container for goods, uses in commerce any word, term, name, symbol, or device, or any combination thereof, or any false designation of origin, false or misleading description of fact, or false or misleading representation of fact ...
- As used in this subsection, the term “any person” includes any State, instrumentality of a State or employee of a State or instrumentality of a State acting in his or her official capacity. Any State, and any such instrumentality, officer, or employee, shall be subject to the provisions of this chapter in the same manner and to the same extent as any non governmental entity."
What are the Requirements?
To become employed (licensed) as a Kentucky Colonel™ you must be an adult between 21-80 years of age, you should have a valid state or national identification, a commission signed by the governor, be of sound mind, you should not have any felony convictions on your record within 5 years, drunk driving arrests within 7 years, may not currently be on parole or probation, and never have been charged with domestic violence since you became recognized as a Kentucky Colonel.
Colonels that do not pass this bar, may still purchase a 1/20th (.05%) portion of a share, and the dues to receive an ID Card with the reason for suspension included in the programmable online data connected to their profile. It shall be the policy of the cooperative to maintain ownership claim over ID Cards at all times that are lost, stolen, reported or confiscated by law enforcement offering a reward for their confidential and direct return, this reward shall be taken from the cooperative fund and billed to the card holder; if a lost, stolen or confiscated card is not returned or recovered in 30 days a new one can be issued.
If a Kentucky Colonel is arrested or convicted of a crime, they should contact the governor's office and request a pardon if their activities were relative to their colonelcy; or voluntarily inform the governor of what happened so he/she can decide what they should do or to maintain your colonelcy. Most likely if the police know you are a Kentucky Colonel and you are doing a good job of it, you will never be arrested! If you are arrested in another country, we hope you were not doing anything to embarrass us.
This is What it Looks Like! Business Details
Our formation is more similar to a start-up because our goal is to operate as a Cooperative Service Organization 501(f) funding Educational Institutions as well as provide benefits and services to our members as a cooperative that will be qualified as a 501(c)(3) or other tax-exempt status because it provides limited financial profits for its owners as its operators. Owners are required to remain connected because they are working, as we might imagine being connected with nothing to do or not being connected and confused is much worse if you really care about your Kentucky Colonel Commission. There is really much to do!
As a start-up business our company (Kentucky Colonel Decentralized Division) is comprised of a network social enterprise focused on intellectual property and publishing activities with a starting estimated valuation of a humble $1,000,000 USD for all of our 6 Internet domain names, 4 websites, social media accounts, and website traffic generated from search results of 160,000 visitors each year; still undercooked, and far from complete in need of financing and expert technical attention to supplement diligent historical investigations; but either way is more substantial and significant data than any other similar website with over 5,000 resources listed or connected. As we can imagine a book or a documentary is perhaps worth more than an equitable million dollars, we have identified enough public domain content to make a 10 season mini series based on real-life events.
Investment in the Cooperative
To invest in the cooperative the initial cost of one full equitable share is $1,000 (until revaluation in 6-18 months), investors can purchase more than a single share like (2 or 3) or as little as 1/20th (5%) of a single share and the annual dues are $250 per year to provide legal and publishing services to our subscribers. The $250 in annual dues can also be paid monthly for $25 per month making it $50 per year more expensive, but that also pays down another 5% of your cooperative share each year for the next $19 years.
The dues are waived the first year for those purchasing at least one full share now. Earnest investors with at least one share, will have a single vote, they will maintain the right to participate in the First General Assembly online, they can be invited to organizational committees and will receive their Kentucky Colonel ID as a Work Identification with partial immediate access and full-access to the network no later than February 20, 2023. Investments made prior to 12/31/2022 are 100% tax-deductible as a charitable contribution to our sponsor organization(s) Globcal International and Ecology Crossroads, which are responsible for our legal formation as a hybrid cooperative through 2025, putting us on the map is their objective.
To be considered self-employed as a volunteer cooperator or cooperative consumer without investing so much, or to design gear and products for the Office of the Kentucky Colonel, such as official business cards, badges, emblems, the state seal patch, jackets or other uniform products and/or get an Honorificus Kentucky Colonel ID Card; the cost is a prepaid annual subscription to the cooperative of $250 or $25 monthly and invest in one-tenth of one-share for $100 plus the cost of the identification card $39.50 which can be applied for in January of 2023. All nonvoting levels of participation will be classed as volunteer, but they will still be bound to the official historical website and virtual workplace. We will not be producing ID Cards for those who do not identify themselves as "self-employed" and as "civilian officers", all ID Cards will add privileges to your Honorable Title not realized elsewhere.
What we can offer to all those that purchase a share in the cooperative or a portion of a share is that you will always be in the priority charter membership class, which will entitle you to free upgrades and offers for products and promotions. Charter members will also be listed in the cooperative charter documents for our own colonelship. Prices are subject to change in the next 60 - 90 days, once the initial campaign is concluded.
Identification Cards
Everyone that joins will be assigned an electronic ID first in order to access the cooperative network (Cloud ID), which is needed in order to obtain a hard-printed plastic ID card with RFID and multifunctional chip, full one share owners will have the opportunity to create subdomain websites or websites for their projects that are related to Kentucky colonelcy and colonelling. In order to create an ID Card owners must commit to 50 hours per year of work online and in their own community, they must also develop a work profile in our network which is accessible using a smartphone or PC.
Once the cooperative reaches 100 single share stakeholders or 900 part owners a consensus will be able to be developed and the pre-planned initiatives and objectives set into motion, the organizers will convene. If we reach these goals prior to December 31, 2022; the organizers will meet within 10 days to set the projects in motion so that Professional Work Credentials "Kentucky Colonel ID Cards" can be sent within 2-3 weeks.
What is Important? (The Cooperative Logic)
Most importantly for a Kentucky Colonel, is not to confuse themself or allow others to become confused between the ideal of a Kentucky Colonel and any products or trademarked membership services registered in commerce called "Honorable Order of Kentucky Colonels®", "Kentucky Colonels®" or "Kentucky Colonel®" which are not the actual Description, Person, Title or the Office of the Kentucky Colonel nor represent the Office of the Colonelcy or the Commonwealth Colonels Cooperative.
Cooperative employee/owners must present evidence of their legal status, sign a non-disclosure agreement, a liability waiver and complete a code of conduct worksheet before they are permitted to legally represent the Office of the Colonelcy as a Kentucky Colonel. They are also required to agree to the implied terms and conditions of the Volunteer Protection Act of 1997 as it may apply to them in their role as a colonel, as well as any and all types of agreements that may be updated from time to time.
Principles: There are two types of cooperative employment both involve a symbolic legal payment of $1 per year (a United Nations Model for Goodwill Ambassadors) to each Colonel including volunteers and visionaries that are employed. Both types of affiliation with the cooperative require investment of earnest money (or valuable trade) to receive the mutual benefits or dividends of the cooperative society.
The first of the Rochdale Principles states that cooperative societies must have an open and voluntary ownership. "Cooperatives are voluntary organizations, open to all persons able to use their services and willing to accept the responsibilities of ownership, without gender, social, racial, political or religious discrimination." Generally cooperatives are only limited by size because it is the members providing the services to themselves to create a collective advantage and purchasing power. Once a cooperative is well organized it can perform most types of business between its members without assuming any debt, risk or liability.
New Cooperative Investment Program Ideas
Our aim is to form a multifunctional, multilevel, multinational and multipurpose cooperative that is qualified to call itself both a Cooperative Service Organization under 501(f) and a Cooperative Social Enterprise under 501(c)(3) that remains equitable for its investors, pays dividends, creates benefits, involves direct investment strategies in projects that are originated from Kentucky ideas and that boost Kentucky economic development, heritage and tourism sectors. As a 501(f) organization, members can partner with third-parties to direct their investment dividends where they are most needed to preserve Kentucky for the future under their own authority.
Renewable assets investments in real-estate developed through Nature-based Solutions and carbon markets by Kentucky colonels focused on state, national and international forest preservation can be used to create economic development opportunities that are aligned with job creation, sustainable development and ecosystem restoration. There are lots of good things colonels can do especially with the environment, tourism and economic development under their lawful authority. Most likely colonels will be able to direct the excess value of their share to projects and programs that they have a hand in developing or overseeing, the environment is likely to be high on the types of investments we can offer because it pays out up to 50% of the value each year, it will be up to colonels how to safely roll over their investors funds each year on-time.
